The Navigation/Advocate Services

 

Still Here provides patient navigation and advocacy services to assist breast cancer clients in finding suitable healthcare providers. Our services involve matching clients with healthcare providers based on their specific needs and preferences. Still Here will also offer additional advocacy and navigational services based on the need of the client if it is within the scope of our practice. However, Still Here is not a medical provider and does not offer medical advice or treatment.

 

No Guarantee of Results

Still Here LLC ("Still Here") strives to provide the highest level of service and support to our clients. However, it is important to note that while we make every effort to assist and advocate for our clients, we cannot guarantee specific outcomes or results.

  1. Individual Circumstances: Each client's situation is unique, and the success or outcome of any advocacy or navigation services provided by Still Here may vary depending on numerous factors, including but not limited to the client's specific medical condition, healthcare providers, insurance coverage, and external circumstances beyond our control.

  2. Limitations of Services: Still Here's services are intended to offer guidance, support, and assistance in navigating the healthcare system, connecting clients with appropriate resources, and advocating for their needs. While we employ qualified professionals and utilize our expertise, the ultimate decisions, treatments, and outcomes are determined by healthcare providers, insurance companies, and other relevant parties.

  3. Not a Substitute for Professional Advice: The information and guidance provided by Still Here should not be considered as a substitute for professional medical, legal, financial, or other expert advice. Clients are advised to consult with their healthcare providers, legal advisors, financial advisors, or other relevant professionals for specific guidance related to their individual circumstances.

  4. Assumption of Responsibility: By engaging our services, clients understand and accept that they bear ultimate responsibility for their healthcare decisions, choices, and actions. Still Here shall not be held liable for any direct or indirect damage, losses, or harm arising from the use or reliance on our services, information, or advice.

  5. No Warranty or Endorsement: Still Here does not warrant the accuracy, completeness, or reliability of any information, resources, or recommendations provided. Fees and Subscriptions Terms and Conditions

These Terms and Conditions ("Terms") outline the payment, fees, and subscription terms for the services provided by Still Here LLC ("Still Here"). By accessing or using our services, you agree to comply with these Terms.

  1. Payment and Fees: You agree to pay all applicable fees and charges associated with the services provided by Still Here. These fees may include, but are not limited to, consultation fees, provider-matching fees, membership fees, or fees for specific services or packages. All fees are stated in U.S. dollars unless otherwise specified.

 

  1. Pricing and Changes: Still Here reserves the right to modify, update, or change the pricing and fees for its services at any time. Any changes in fees will be communicated to you in advance, and you will have the option to accept the new fees or terminate your subscription or services.

  2. Subscription Services: If you subscribe to any recurring services or membership plans offered by Still Here, you agree to pay the recurring subscription fees as specified. These fees will be automatically charged to your provided payment method at the agreed-upon interval, such as monthly or annually.

  3. Payment Authorization: By providing your payment information, you authorize Still Here or its third-party payment processors to charge the specified fees to your designated payment method. You represent and warrant that you have the necessary authorization to use the payment method provided.

  4. Renewal and Cancellation: Subscriptions will automatically renew for the designated period unless canceled or terminated by you or Still Here. You may cancel your subscription at any time by following the cancellation procedure specified in your account settings or by contacting Still Here directly.

  5. Taxes: You are responsible for any applicable taxes or duties associated with your use of the services. Still Here reserves the right to collect and remit taxes or duties as required by law. 

  6. Non-Payment: Failure to make payment for services or subscription fees may result in the suspension or termination of your access to Still Here's services. Still Here reserves the right to pursue collection measures for any outstanding balances, including the use of collection agencies or legal action. If payment is not received from your credit card issuer, you hereby agree to pay all amounts due upon demand. You agree to pay all costs of collection, including attorney’s fees and costs, on any outstanding balance. In certain instances, the issuer of your credit card may charge you a foreign transaction fee or related charges, which you will be responsible to pay. You are advised to check with your bank and credit card issuer for details.

  7. Third-Party Payment Processors: Still Here may use third-party payment processors to handle payment transactions. Your use of such payment processors is subject to their respective terms and conditions and privacy policies. Still Here is not responsible for any actions, errors, or omissions of third-party payment processors.

 

Changes to Terms: Still Here reserves the right to modify or update these Terms at any time. Any changes will be effective upon posting on the Still Here website or notifying you directly. Your continued use of the services after the posting of any modifications constitutes your acceptance of the revised Terms.

Retainer Fee Section

  1. Retainer Fee: Still Here LLC ("Still Here") requires a retainer fee to secure services provided to clients. The retainer fee is an upfront payment that reserves our services and initiates the engagement process.

  2. Amount and Payment: The retainer fee is set at 50% of the total estimated service fee, unless otherwise specified and agreed upon by Still Here LLC and the client. The client shall remit the retainer fee payment prior to the commencement of services.

  3. Remaining Fee: The remaining balance of the service fee is due upon completion of the agreed-upon services unless alternative payment arrangements have been made and agreed upon by Still Here LLC and the client. The client acknowledges that the services will not be considered complete and final until the remaining fee has been received by Still Here.

  4. Payment Methods: Payment of the retainer fee and remaining fee can be made by the client through the accepted methods specified by Still Here. These may include, but are not limited to, credit/debit card payments, electronic funds transfer (EFT), or other mutually agreed-upon payment options.

Please read these Terms carefully before using our services. By accessing or using Still Here's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and any applicable additional terms or policies.


 

Subcontractor Terms and Conditions

These Subcontractor Terms and Conditions ("Terms") outline the agreement between Still Here LLC ("Still Here") and subcontractors who provide additional services, such as medical billing and coding, that may be out-of-scope for Still Here's practice. By entering into a subcontractor relationship with Still Here, you agree to comply with these Terms.

  1. Referral and Engagement: Still Here may refer clients to subcontractors for additional services that are beyond the scope of Still Here's practice. The referral is made solely as a convenience to the client, and the decision to engage the subcontractor's services rests solely with the client.

  2. Client Fees and Payment: If a client engages the services of a subcontractor referred to by Still Here, the client will be responsible for all fees and payments associated with those services. Still Here will not be responsible for any financial transactions or contracts entered between the client and the subcontractor.

  3. Referral Fees: In consideration for referring clients to subcontractors, Still Here shall receive a referral fee of 10% of the total fees charged by the subcontractor to the client. This referral fee will be invoiced and payable by the subcontractor after receiving payment from the client.

  4. Indemnification: The subcontractor agrees to indemnify and hold Still Here harmless from any claims, liabilities, damages, or expenses arising out of the subcontractor's services or the engagement with the client. This includes but is not limited to any disputes, non-payment issues, or legal matters arising from the subcontractor's relationship with the client.

  5. Independent Contractor Relationship: The subcontractor is an independent contractor and not an employee, partner, or agent of Still Here. The subcontractor is solely responsible for their own business operations, including obtaining any necessary licenses, insurance, and complying with applicable laws and regulations.

  6. Confidentiality: The subcontractor agrees to maintain the confidentiality of any client information shared by Still Here, including but not limited to personal and medical information. The subcontractor shall not disclose or use this information for any purpose other than providing the agreed-upon services.

  7. Termination: Either party may terminate the subcontractor relationship at any time with written notice. Termination will not affect any ongoing obligations or liabilities accrued prior to the termination date.

  8. Governing Law and Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the governing law and jurisdiction would be different depending on the state in which the subcontractor agreement is based. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of state in which the subcontractor agreement is based. 

  9. Still Here LLC is not responsible for any legal fee under the subcontractor/client’s relationship.

Indemnification

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. If any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regard to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.
 

Class Action Waiver 

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Still Here LLC agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

Termination/Access Restriction

Still Here LLC reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of North Carolina, and you hereby consent to the exclusive jurisdiction and venue of courts in North Carolina in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Still Here LLC because of this agreement or use of the Site. Still Here LLC's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Still Here LLC's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Still Here LLC with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Still Here LLC with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the user and Still Here LLC with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

Changes to Terms

Still Here LLC reserves the right, in its sole discretion, to change the Terms under which www.stillhere.llc is offered. The most current version of the Terms will supersede all previous versions. Still Here LLC encourages you to periodically review the Terms to stay informed of our updates.
